1.About these terms

These Terms of Service (the "Terms") are a binding agreement between you and MetaDuels is operated by [Registered company name], a company registered in Kenya under number [Company registration number], with its registered office at [Registered office address], Nairobi, Kenya. In these Terms, "MetaDuels", "we", "us" and "our" refer to that company, and "you" refers to anyone who visits or uses metaduels.com, our apps, or any related service (together, the "Platform").

By creating an account, entering a competition, or otherwise using the Platform, you accept these Terms together with the documents they incorporate: the Privacy Policy, Cookie Policy, Fair Play Policy, Prize Rules, and any rules published for a specific event. Where an event's rules conflict with these Terms, these Terms apply unless the event rules expressly say otherwise.

Licensing. MetaDuels operates competitions in accordance with applicable law; licence details: [to be added].

If you do not agree to these Terms, do not use the Platform.

2.Eligibility and age tiers

The Platform is open to players aged 6 and over. Your date of birth, entered at sign-up, places you in one of three age tiers. The tier decides which games you can see, how you can chat, and which prizes you can receive. It is enforced on our servers and cannot be changed without contacting support and providing proof of age.

Where the age of majority in your country is higher than 18, you are treated as a minor until you reach it, and you must not use cash features until then. Tournaments never mix tiers.

You must give your true date of birth. Misstating your age is a serious breach of these Terms. We may ask for proof of age at any time, and we may close accounts, cancel results and withhold prizes where an age was misstated.

3.Minors and guardian consent

If you are under 18, you need the verifiable consent of a parent or legal guardian before you can enter any competition. At sign-up you give us your guardian's contact details, and we send them a request to review and approve your account. Until they approve, you can browse and play practice games, but you cannot compete or win prizes.

By approving a minor's account, the parent or guardian confirms that they:

  • are the child's parent or legal guardian, and have authority to consent on the child's behalf;
  • have read and accept these Terms and the Privacy Policy on the child's behalf, and agree to be responsible for the child's use of the Platform;
  • consent to us processing the child's personal data as the Privacy Policy describes.

A guardian may at any time:

  • review the personal data we hold about the child;
  • ask us to correct or delete it, or to stop collecting it;
  • withdraw consent, which immediately ends the child's access to competitions; and
  • receive notices of prizes the child wins, and confirm how school-item prizes are delivered.

Guardians can exercise these rights by writing to privacy@metaduels.com from the email address they registered. We may take reasonable steps to confirm the guardian's identity before acting. If we learn that a child under 18 is competing without valid consent, we will suspend competitive access and may delete the account.

4.Your account

  • One account per person. You may hold only one account. Creating, buying, selling, sharing or using additional accounts is prohibited.
  • Accurate details. Your name (where requested), date of birth, country, email and phone number must be true and kept up to date.
  • Security. Keep your password secret and use it only on MetaDuels. You are responsible for all activity on your account. Tell us immediately at support@metaduels.com if you suspect unauthorised access.
  • No account transfers. Accounts, gamer tags, balances, rankings and prizes are personal and cannot be transferred.
  • Identity checks (KYC). Before any cash withdrawal, and whenever the law requires or we reasonably suspect fraud, we may ask you to verify your identity, age, address and the ownership of your payout method. Payouts are made only to a payout method in your own name. If you do not complete verification, we may hold withdrawals until you do.

5.Skill-based competitions

MetaDuels runs competitions of skill. The outcome of every competition is determined by the players' skill and performance, not by chance. We do not offer betting, wagering on the outcome of other people's matches, lotteries, or games of chance, and spectators cannot stake money on any result.

Results are established as follows:

  • Arcade. Every ranked arcade run records your inputs. Our server replays the run from those inputs and only accepts the score the replay produces. Runs that trip automated fair-play checks are held for human review.
  • API-verified games. For supported titles, including Chess on Lichess, Clash Royale and Brawl Stars, we read the match result directly from the game publisher's official API using the game account you linked.
  • Other titles. Both players report the score. Matching reports confirm the result. Conflicting reports go to a referee or moderator, who decides on the evidence, including screenshots.
  • Showdown trivia. Answers and response times are scored by our server.

The decision of the referee or moderator on a match result is final, subject only to the appeal process in the Fair Play Policy and to any rights you have under mandatory law.

6.Fair play and conduct

You must compete honestly. Cheating, hacking, bots and automation, exploiting bugs, collusion, match fixing, multi-accounting, smurfing, account sharing or boosting, false score reports, and harassment are prohibited. The Fair Play Policy describes these rules, how we detect breaches, and the penalties in detail.

If we reasonably determine that you breached the Fair Play Policy, we may, in addition to any other remedy, disqualify you, reverse results, and forfeit any prizes and winnings connected with the breach, including entry fees paid into the affected events, to the extent the law allows. Forfeited prizes may be awarded to the next eligible players.

7.Entry fees, escrow and refunds

  • Adults only. Paid entry is available only to verified adults. Junior and Youth events are free to enter.
  • Escrow. When you join a paid event, the entry fee moves from your wallet into that event's escrow and stays there until the event is completed or cancelled. Sponsor prize pools are locked in escrow before an event goes live, so an advertised prize always exists.
  • Platform fee. We charge a platform fee on paid events, shown on the event page before you join. It is deducted from the prize pool when prizes are distributed.
  • Leaving an event. You can leave a paid event and receive a full refund of your entry fee until the bracket starts. After the bracket starts, entry fees are non-refundable.
  • Cancelled events. If an event is cancelled before it is completed, for any reason other than your own breach of these Terms, every entry fee is refunded in full to the entrant's wallet.
  • No-shows and forfeits. If you do not show up for a match within the time the event rules allow, you forfeit the match. Entry fees are not refunded for forfeits or disqualifications.

Amounts are settled in US dollars. Local-currency figures are shown for convenience using reference exchange rates and may differ from what your bank or mobile-money provider charges.

8.Wallet, deposits and withdrawals

Adult players can hold a MetaDuels wallet. Deposits and withdrawals are processed by our payment provider, Paystack, by card or mobile money where available. We never see or store your full card number.

  • Your wallet balance is not a bank deposit, does not earn interest, and may be used only for entry fees and withdrawals on the Platform.
  • Withdrawals always require your password, may require identity verification, and larger withdrawals are reviewed by a second staff member before release.
  • We may delay, hold or refuse a deposit or withdrawal where we reasonably suspect fraud, money laundering, a chargeback, a breach of these Terms, or where the law requires it, and we may report suspicious activity to the relevant authorities.
  • If you charge back a deposit without good reason, we may recover the amount from your wallet and suspend your account.
  • Withdrawal limits, fees and processing times are shown in your wallet before you confirm.

9.Prizes

Prize types depend on your age tier:

  • Junior (under 13): school items of equal value, such as school supplies, calculators and books. Guardians are notified and confirm delivery.
  • Youth (13 to 17): your choice of airtime, gift vouchers or school items of equal value.
  • Adult (18+): your choice of airtime, gift vouchers, or a cash withdrawal to your verified card or mobile-money account.

Prizes are awarded only after the result is confirmed and any fair-play review is complete. The full claim process, deadlines and conditions are in the Prize Rules.

10.Taxes

You are responsible for declaring and paying any taxes that apply to prizes you receive. Where the law requires us to withhold tax from a prize, such as withholding tax on winnings in some countries, we deduct it before paying the prize, pay it to the relevant authority, and show the deduction to you. We do not give tax advice.

11.Regional restrictions

Void where prohibited. Paid competitions and prizes are offered only where they are lawful. You must not enter a paid competition, or accept a prize, if doing so is illegal where you live or where you are when you play. It is your responsibility to know and follow your local laws.

We may restrict, disable or modify features, entry fees, prizes or payment methods in any country or region, and may block access from places where we cannot lawfully offer them. Using a VPN, proxy or false location details to get around a restriction is a breach of these Terms, and any winnings obtained that way are forfeited.

12.Your content, names and chat

You keep ownership of content you submit, such as gamer tags, profile images, chat messages and match screenshots ("User Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and adapt it as needed to run, moderate and promote the Platform, including showing your gamer tag on brackets and leaderboards. For Junior players we never show real names, and we show gamer tags only.

Gamer tags, team names and other User Content must not:

  • contain profanity, slurs, hate speech, sexual content, threats or harassment;
  • impersonate another person, a MetaDuels staff member, a brand or a game publisher;
  • include personal contact details, links, or invitations to move off the Platform;
  • infringe anyone's rights, or break any law.

We use automated filters, including a profanity filter on names and chat, as well as human moderation. We may reject, rename, hide or remove any User Content, and apply penalties for breaches, at our discretion. Chat for minors is restricted by tier as described in section 2.

13.Third-party games and services

Many competitions use games owned by third parties. MetaDuels is not affiliated with, endorsed by, or sponsored by any game publisher unless we say so. Game names and trademarks belong to their owners and are used only to identify the games. Clash Royale and Brawl Stars are trademarks of Supercell Oy. MetaDuels is not affiliated with, endorsed, sponsored, or specifically approved by Supercell, and Supercell is not responsible for it. Chess results are retrieved from Lichess, which is likewise not affiliated with MetaDuels.

You must follow the terms of service of each game you play and of any account you link. We are not responsible for third-party games, servers, APIs or outages. If a publisher's API is unavailable, we may verify results by other means, reschedule, or cancel the affected matches.

14.Our intellectual property

The Platform, including its software, arcade games, design, text, graphics and the MetaDuels name and marks, is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose under these Terms. You must not copy, modify, reverse engineer, scrape, or build tools that interact with the Platform in an automated way, except as the law expressly allows.

15.Suspension and termination

You may close your account at any time by contacting support. Any withdrawable balance will be paid to your verified payout method, after any checks we are required to perform.

We may suspend or close your account, with or without notice, if you breach these Terms, if we are required to by law, if we reasonably suspect fraud or abuse, or if we stop offering the Platform. Where we close your account for reasons other than your breach, we will refund your withdrawable balance. Where we close it because of your breach, we may withhold and forfeit winnings and balances connected with the breach, to the extent the law allows.

Sections that by their nature should survive termination, including those on fees owed, forfeiture, liability, indemnity and disputes, survive.

16.Disclaimers

We work hard to keep the Platform fair, secure and available, but we provide it "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, uninterrupted availability, or that the Platform is free of errors. Nothing in these Terms excludes any warranty or guarantee that cannot be excluded under the consumer law that applies to you.

17.Limitation of liability

To the fullest extent permitted by law:

  • we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data, goodwill or opportunity, including the chance of winning a prize;
  • we are not liable for losses caused by your internet connection, device, a third-party game or service, or events beyond our reasonable control;
  • our total liability to you for all claims arising from the Platform in any 12-month period is limited to the greater of (a) the entry fees you paid to us in that period and (b) US$100.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under applicable law.

18.Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless MetaDuels, its officers, employees and partners from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your violation of any law or third-party right. This section does not apply to consumers where local law prohibits it.

19.Disputes and governing law

Talk to us first. Most issues are resolved quickly by support. Before starting any formal claim, write to support@metaduels.com describing the issue, and give us 30 days to try to resolve it.

Governing law. These Terms and any dispute arising from them are governed by the laws of the Republic of Kenya. The courts of Kenya have jurisdiction, and parties may also agree to resolve a dispute by arbitration in Nairobi under the Arbitration Act, 1995.

Consumer protections. If you are a consumer living outside Kenya, nothing in this section removes the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts of that country where its law gives you that right. Consumers in the European Union can also use their national consumer dispute resolution bodies.

Match results are decided under the Fair Play Policy and are not subject to this section, except where mandatory law provides otherwise.

20.Changes to these terms

We may update these Terms to reflect changes to the Platform, the law, or our business. We will post the new version here with a new "Last updated" date. If a change materially affects your rights, we will tell you in advance by email or on the Platform. Changes do not apply to events you have already entered. If you continue to use the Platform after a change takes effect, you accept the updated Terms; if you do not agree, you can close your account.

21.General

  • These Terms, with the documents they incorporate, are the entire agreement between you and us about the Platform.
  • If any provision is found unenforceable, the rest remains in force.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign your rights under these Terms. We may assign ours to a successor business, without reducing your rights.
  • We are not responsible for delays or failures caused by events beyond our reasonable control.
  • These Terms are written in English. Any translation is for convenience only.
